By Sheriff Scott Henriod

At last week’s city council meeting the Ely City Council voted to allow a special use permit to be issued to Acres Dispensary, LLC.

The permit is to allow this business to open a medical marijuana dispensary located at 940 E. Aultman St. in the City of Ely.

As many of you are aware, the marijuana laws changed January 2017. I thought I would take this opportunity to review the changes in the law that have taken place since that time.

The law now allows individuals over the age of 21 to possess up to one ounce of marijuana.

You cannot smoke marijuana in a public place. You can smoke it in your own home. If you rent or lease a home, make sure you have a signed agreement with the actual owner of the home to allow you to use marijuana inside the residence.

If you don’t then you could be in violation of your renter’s agreement and subject to eviction.

You cannot smoke it inside a moving vehicle, and yes you can be arrested for driving under the influence of marijuana.

You cannot smoke marijuana around children or minors, and you cannot possess a firearm while being under the influence of marijuana.

If you need any clarification on the laws that regulate marijuana and it use please feel free to contact the Sheriff’s Office.
